Digital Tools Privacy Policy and Terms of Use

This Privacy Policy and Terms of Use explain how personal data is processed within the web applications and tools operated by Oriol Guitart (the “Tools”), which require registration to use, and the conditions for accessing them. The privacy section is issued in compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

2. Data we collect

Account data: name, email address, and optionally your company or professional role, provided when you register. Your password is stored in encrypted (hashed) form by our authentication provider and is never accessible to us in plain text.
Content you create: the analyses, simulations, events, evaluations, and related information you enter and save in the Tools.
Collaboration data: if you invite another person to a shared item, the email address you provide for that invitation; if you accept an invitation, the record of your access to the shared item.
Technical data: an authentication token stored in your browser to keep you signed in, and basic technical and usage information needed to operate and secure the Tools.

Providing your account data is necessary to create an account and use the Tools. Without it, you cannot register or access the Tools.

3. Purposes of processing

To create and manage your account and give you access to the Tools (authentication, saving and retrieving your work).
To send you service (transactional) emails: email verification, password reset, and collaboration invitations, and to notify the owner of new registrations.
To provide optional features that process the content you enter at your request, including AI-assisted diagnostics that generate advisory text based on the data you submit.
To keep the Tools secure and prevent abuse.

We do not use your data for advertising and we do not sell it.

4. Legal basis

Performance of the service you request (your registration and use of the Tools).
Your consent, where you provide it (for example, optional communications), which you may withdraw at any time.
Our legitimate interest in the security and proper functioning of the Tools.

5. Recipients and processors

We use the following service providers, which process data on our behalf under a data-processing agreement and only on our instructions:

Supabase: database and authentication (storage of account data and the content you save).
Resend: delivery of transactional emails.
Lovable: application hosting and infrastructure.
AI service provider: where you use an AI-assisted feature, the content you submit for that feature is processed to generate the result.

We do not transfer your data to any other third parties except where required by law.

6. International transfers

Some of the providers above are located in or process data in countries outside the European Economic Area, including the United States and Singapore. Where data is transferred outside the EEA, it is protected by appropriate safeguards, in particular the European Commission’s Standard Contractual Clauses (Implementing Decision (EU) 2021/914) and, where applicable, adequacy decisions.

7. Data retention

Your account data and saved content are retained while your account remains active. If you request deletion of your account, your data is deleted within a reasonable period, except where the law requires it to be kept longer. Collaboration invitations expire automatically after 7 days.

8. Your rights

You may exercise the rights of access, rectification, erasure, restriction, objection, and portability, and withdraw your consent at any time, by writing to oriol@oriolguitart.com. We will verify your identity in a proportionate manner. You also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es).

9. Automated processing

AI-assisted features generate advisory text based on the data you enter. They do not make decisions that produce legal or similarly significant effects about you.

10. Security

We apply appropriate technical and organizational measures to protect the confidentiality and integrity of your data. Passwords are stored in hashed form by our authentication provider.

11. Children

The Tools are intended for professional use and are not directed to minors under the age of 16.

12. Changes

This document may be updated to reflect legal or operational changes. Registered users will be informed of material changes.

14. Terms of Use and access to the Tools

Access to the Tools is provided at the developer’s discretion. Oriol Guitart may change the access model of any Tool at any time, including offering it as free, freemium, premium, or paid, introducing more advanced paid versions, or limiting, suspending, or discontinuing any Tool or feature. Free access is not guaranteed and may change or end at any time.

Where a material change to the access model affects registered users, it will be announced with reasonable notice. Changes apply going forward, and continuing to use a Tool after a change takes effect constitutes acceptance of the new conditions.

The Tools are provided “as is”, without warranty of any kind. To the extent permitted by applicable law, the developer is not liable for any loss arising from the use of, or inability to use, the Tools.
